The Insolvency Department at Harris + Harris acted for the spouse of the Bankrupt in a claim by the Trustee in Bankruptcy against the matrimonial home in which our client lived and had a joint interest. We advised the client of the powers & duties of the Trustee and the client's own rights of occupation. Negotiations enabled our client to conduct the sale, reducing the stress of the sale and allowing her to achieve the maximum value of her interest in the property. Agreement was also reached with the Trustee allowing our client to be credited with the value of improvements made to the property.

David Holmes, head of the Insolvency Department said, "This type of case requires careful handling. Few high street practices have any experience of dealing with this sort of matter. We carefully examined the circumstances and it became apparent that the property would have to be sold. However, by negotiating a sale of the property by our client direct rather than the Trustee we managed to reduce the stress to members of the family when the property was sold and further to contain the costs of the Trustee, which would otherwise have been paid out of the proceeds of the sale" .
